Terms and Conditions
1. Provider and Scope
1.1 These Terms and Conditions (“Terms”) govern bookings, purchases and use of experiences, retreats, programmes, events, memberships, digital content and related services offered under the Swiss Wellthspan Connect brand (“SWC”, “we”, “us” or “our”).
1.2 The contracting party is Wellthspan Advisory & Burget Consulting, Switzerland, email Connect(a)swisswellthspan-connect.com (“Provider”). Swiss Wellthspan Connect is a brand and ecosystem operated by the Provider.
1.3 These Terms apply to consumers and business customers unless a provision expressly states otherwise. Additional or event specific terms shown on a product page, ticket, proposal or booking confirmation form part of the contract. In case of conflict, a signed individual agreement prevails, followed by the booking confirmation, event specific terms and these Terms.
1.4 Terms of hotels, venues, practitioners, transport providers or other third parties may apply to services contracted directly with them.
2. Information, Booking and Contract Formation
2.1 Descriptions, schedules, images and availability shown on our website are invitations to place an order and do not constitute a binding offer unless expressly stated otherwise.
2.2 Before submitting an online order, the customer can review and correct the selected services and information. By selecting the final purchase or registration button, the customer submits a binding order and accepts these Terms and the event specific terms.
2.3 A contract is formed when SWC sends an electronic booking confirmation or otherwise expressly accepts the order. An automated acknowledgement of receipt is not an acceptance unless it clearly confirms the booking.
2.4 The person making a group booking confirms that they are authorised to provide the participant information and to communicate all applicable conditions to the other participants. The booking person remains responsible for payment unless SWC agrees otherwise.
2.5 SWC may reject a booking for legitimate reasons, including lack of availability, unmet eligibility or safety requirements, suspected misuse or non-payment.
3. Prices and Payment
3.1 Prices are stated in Swiss francs unless indicated otherwise and include Swiss VAT where applicable. The checkout or proposal identifies what is included and any additional mandatory charges.
3.2 Payment is due at the time and by the method stated during checkout, on the invoice or in the proposal. A place is not secured until the required payment has been received unless SWC confirms otherwise in writing.
3.3 If payment is overdue, SWC may set a reasonable grace period, suspend access or cancel the booking. Statutory default interest and reasonable collection costs remain reserved.
3.4 Customers are responsible for their own bank, foreign exchange and card issuer charges.
4. Experience Inclusions and Third Party Services
4.1 The booking confirmation states whether accommodation, meals, transfers, assessments, treatments, equipment or other services are included. Travel to and from the destination, insurance, personal expenses and services not expressly listed are excluded.
4.2 SWC works with independent experts, hotels, venues and service providers. Where a third party supplies a service in its own name, the customer contracts directly with that provider and its terms apply. SWC remains responsible for services it has expressly contracted to provide in its own name.
4.3 If an offering qualifies as a package under the Swiss Federal Act on Package Travel, mandatory rights under that Act prevail over any inconsistent provision of these Terms.
5. Programme Changes
5.1 SWC may make reasonable changes to experts, speakers, activities, venues, accommodation, menus or timings where necessary for operational, safety, health, weather or quality reasons. SWC will seek to maintain the overall character and value of the booked experience.
5.2 If SWC makes a material change before the start that significantly reduces the core value of the booking and cannot offer a reasonable equivalent, the customer may accept the change, transfer to a suitable alternative or cancel the affected service for an appropriate refund. SWC will communicate the available options and response deadline.
6. Minimum Participation and Cancellation by SWC
6.1 An experience may be subject to a minimum participant number stated on the event page or booking confirmation. Unless otherwise stated, SWC will communicate a cancellation for insufficient participation no later than 14 days before the start.
6.2 SWC may cancel or discontinue an experience where it cannot be performed safely or reasonably, including because of insufficient participation, expert unavailability without a suitable replacement, venue failure, official restrictions, severe weather, force majeure or another material circumstance beyond reasonable control.
6.3 If SWC cancels the entire booked experience before it begins, the customer may choose a full refund of amounts paid directly to SWC for the cancelled service or, voluntarily, a transfer or credit of equal value. SWC does not reimburse independently booked travel, accommodation or other external costs. Participants should use flexible arrangements and appropriate travel cancellation insurance.
6.4 If an experience must be interrupted after it begins, SWC will provide an appropriate remedy considering the services already delivered, recoverable supplier costs and mandatory law. Nothing in this clause limits rights that cannot lawfully be excluded.
7. Cancellation or Changes by the Customer
7.1 Unless event specific terms provide more favourable conditions, a customer may cancel an experience in writing and will receive: (a) 80% of the amount paid to SWC if cancellation is received at least 30 calendar days before the start; (b) 50% if received 15 to 29 calendar days before the start; and (c) no refund if received 14 calendar days or less before the start or in case of a no show.
7.2 The relevant date is the date on which SWC receives the cancellation at: Connect(at)swisswellthspan-connect.com. Refunds are made to the original payment method where reasonably possible.
7.3 A customer may nominate a suitable substitute participant before the start, subject to availability, eligibility, supplier restrictions and SWC’s prior written approval. SWC may charge only reasonable documented costs caused by the substitution.
7.4 Leaving early, arriving late or choosing not to use an included service does not create a refund entitlement.
7.5 Switzerland does not provide a general statutory cooling off period for ordinary online purchases. Any cancellation right is therefore governed by mandatory law, the event specific terms and this clause.
8. Memberships and Digital Services
8.1 The applicable plan description states whether a membership is free, one time or recurring, its term, benefits, price and cancellation conditions. Memberships are personal and may not be shared or resold.
8.2 The Founding Community free early access plan has no membership fee unless the member actively purchases a paid plan or service. SWC may reasonably develop, replace or discontinue free benefits on notice.
8.3 For recurring paid plans, charges are made at the frequency shown during checkout until cancellation or expiry. A cancellation takes effect at the end of the current paid period unless the plan states otherwise. Amounts already charged are not refunded for partial periods except where required by law.
8.4 Digital content is licensed for the member’s personal, non-commercial use. It may not be copied, recorded, distributed, sold, made publicly available or used to train an automated system without prior written permission.
8.5 SWC may suspend access for material breach, misuse, non-payment or security concerns. Where reasonably possible, SWC will first provide notice and an opportunity to remedy the breach.
9. Health, Suitability and Participant Responsibility
9.1 SWC experiences may include physical activity, recovery practices, nutrition related content, bodywork, assessments or other wellbeing activities. Participation may involve inherent risks that cannot be completely eliminated.
9.2 Participants are responsible for assessing their own suitability and obtaining medical advice where appropriate, particularly in case of pregnancy, injury, illness, medication, allergies, cardiovascular conditions, mental health concerns or other relevant limitations.
9.3 Participants must provide accurate information reasonably requested for safety and must promptly inform the responsible professional of relevant changes or discomfort. They may decline or stop an activity at any time.
9.4 General education, coaching, screening or wellbeing content does not replace individual medical diagnosis or treatment. Any regulated medical service is provided only by the identified qualified professional under their own professional responsibility.
9.5 In an emergency, SWC may contact emergency services and share information reasonably necessary to protect life or health. The participant remains responsible for medical and rescue costs unless caused by SWC in circumstances for which SWC is legally liable.
9.6 Participants are responsible for adequate health, accident, travel and personal liability insurance.
10. Conduct, Safety and Exclusion
10.1 Participants must follow reasonable safety, venue and professional instructions and treat other participants, staff, experts, local communities and property respectfully.
10.2 Harassment, discrimination, violence, dangerous conduct, unlawful drug use, serious disruption and participation while impaired in a way that creates risk are prohibited.
10.3 SWC may refuse or end participation where reasonably necessary for safety, wellbeing, legal compliance or the integrity of the group. No refund is due where exclusion results from the participant’s material breach. SWC will consider proportionate alternatives where circumstances allow.
10.4 Participants are liable for loss or damage they cause unlawfully and culpably.
11. Photography, Recording and Media
11.1 Photography and video recording may take place during SWC experiences for documentation, communication, editorial and promotional purposes, including use on SWC websites, social media channels, presentations, newsletters and other digital or printed materials.
11.2 Participants who do not wish to appear in such photographs or recordings must inform SWC before the experience by emailing connect@swisswellthspan-connect.com or notify the host or photographer upon arrival. SWC will take reasonable measures to respect the participant’s preference.
11.3 Where a participant has not raised an objection, SWC may use incidental photographs and recordings showing the general event setting, activities, groups or atmosphere, to the extent permitted by applicable law.
11.4 Clearly identifiable individual portraits, interviews, testimonials or recordings in which a participant is the primary subject may require separate consent. Refusing or withdrawing such consent will not affect participation in the core experience.
11.5 Participants may object to future use of an identifiable image or recording by contacting connect@swisswellthspan-connect.com. SWC will review the request and, where reasonably possible and legally required, discontinue future use. Materials already printed, published, distributed or incorporated into completed productions may not be capable of being recalled.
11.6 Participants may not commercially record, livestream, publish or use another participant’s image, voice or contribution without that person’s permission and, where applicable, SWC’s prior approval.
12. Intellectual Property
12.1 SWC and its licensors retain all rights in brands, concepts, curricula, documents, videos, methods, designs and other materials supplied in connection with the services.
12.2 Customers receive a limited, non-exclusive, non-transferable right to use supplied materials for their own personal or internal business purposes. Publication, adaptation, resale, sublicensing or systematic reproduction requires prior written consent.
12.3 Participants retain rights in their own original contributions. By deliberately submitting content for inclusion in a collaborative session or community feature, they grant SWC the limited rights reasonably necessary to provide that feature, subject to the Privacy Notice and any specific consent.
13. Data Protection
13.1 SWC processes personal data in accordance with applicable data protection law and the SWC Privacy Notice. The Privacy Notice explains the controller identity, purposes, recipients, service providers, international transfers, retention periods and individual rights.
13.2 Health information is sensitive personal data. SWC will request only information reasonably necessary for the stated purpose, restrict access and use express consent where consent is the appropriate legal basis.
13.3 Booking and platform providers, including Wix and payment service providers, may process data under their own terms and privacy information where they act independently.
14. Liability
14.1 SWC is liable without limitation for damage caused intentionally or through gross negligence and for any other liability that cannot lawfully be excluded or limited.
14.2 To the extent permitted by law, SWC is not liable for ordinary negligence in relation to indirect or consequential loss, loss of profit, loss of opportunity or loss of data. For direct loss caused by ordinary negligence, SWC’s aggregate liability is limited to the amount paid by the affected customer for the service giving rise to the claim. This limitation does not apply to death or personal injury to the extent such limitation is prohibited.
14.3 SWC is not liable for the acts or omissions of independent third party providers with whom the customer contracts directly. This does not affect any legal responsibility SWC has for selecting, instructing or presenting a provider or for services sold by SWC in its own name.
14.4 SWC is not responsible for valuables, personal belongings or independently arranged travel except where loss is caused by SWC in circumstances for which liability cannot be excluded.
14.5 Nothing in these Terms excludes mandatory rights under the Swiss Package Travel Act or other applicable consumer law.
15. Force Majeure
15.1 Neither party is liable for delay or failure caused by an event beyond its reasonable control, including natural disaster, epidemic, pandemic, war, civil disturbance, governmental action, transport disruption, utility failure or severe weather, provided the affected party takes reasonable steps to mitigate the consequences.
15.2 Payment, refund and alternative performance consequences are governed by Clause 6, mandatory law and any event specific terms.
16. Complaints
16.1 Concerns should be raised promptly during an experience where an immediate remedy may be possible. Formal complaints must be sent to connect(at)swisswellthspan-connect.com with the booking reference and relevant details.
16.2 SWC will acknowledge and review complaints within a reasonable period. This process does not restrict statutory rights or limitation periods.
17. Changes to These Terms
17.1 The version accepted at the time of booking governs that booking. SWC may update these Terms for future contracts and will publish the effective date.
17.2 For continuing memberships, SWC may make reasonable changes for legal, security, operational or service development reasons. Material adverse changes will be communicated in advance and members may cancel before they take effect where required by law or the applicable plan.
18. Severability, Assignment and Waiver
18.1 If a provision is invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be replaced, to the extent legally possible, by a valid provision that most closely reflects its commercial purpose.
18.2 The customer may not assign a contract without SWC’s consent, except for an approved substitute participant under Clause 7.3. SWC may transfer a contract as part of a genuine business reorganisation or transfer, provided this does not materially reduce the customer’s rights.
18.3 A failure to enforce a right is not a waiver of that right.
19. Governing Law and Jurisdiction
19.1 These Terms and the contractual relationship are governed by substantive Swiss law, excluding conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods.
19.2 The courts at the registered office of the Provider have jurisdiction. Mandatory consumer jurisdiction, including any legally protected jurisdiction at the consumer’s domicile, remains reserved.
